Boulder All Star Movers Terms and Conditions of Service
This document contains important information about your relationship with Boulder All Star Movers, LLC. Please read it and familiarize yourself with its terms.
By purchasing services through Boulder All Star Movers, LLC you agree to the following:
Boulder All Star Movers, LLC is a moving & transportation services company that specializes in residential and commercial relocation. We service Boulder, Denver, and the surrounding areas.
You agree that Boulder All Star Movers, LLC retains no responsibility or liability for any and all losses, damages, injuries, or any actions conducted under this services contract. Additionally, our specialized moving help crews will take reasonable precautions to ensure the safety of your items and valuables, but we require you to notify us well in advance of any items being moved that are worth more than one thousand dollars ($1,000). We will take special care of these valuable items, but neither the company nor our movers can be held responsible for anything that we are not aware of before the move. You are required to notify us of any issues with the move within 48 hours of the end of the move. All insurance claims must be made through the customer's own storage unit or truck insurance, if possible. Our full service moving experts are not responsible for any items that are lost, damaged, unpacked, uncrated or misplaced, unless we are notified within 48 hours of any issues, and it is ultimately determined that our movers were responsible for the issue.
Boulder All Star Movers will not be liable for any damage to any box, crate, bag, or packaged item that is not packaged or boxed by Boulder All Star Movers. We recommend that any items previously boxed or packed are securely placed and safely packed before our arrival. We are not responsible for any damages that arise from poor packaging or improper crating technique. We will go out of our way to ensure the safety of these items but are in no way responsible for any damages to such items that may arise.
Any box that is not sealed, taped, or packaged correctly, i.e, items coming out of the top, or budging out of the designated box space, will not be covered by our insurance liability or subject to damage liability. Plants, lamps, or any exposed items besides regular furniture items will also be limited to our liability and damage coverage. Any panes of glass must be properly crated or packaged. At all times, we retain the right to refuse to move any items that we deem unfit for moving for any reason, in our sole and unfettered discretion.
Services Rendered: Our services are offered in hourly increments. Any time over 20 minutes into the hour that our movers work on your job shall constitute a full hour of service for billing purposes, based on your quoted hourly rate. Charges for the hourly rate will begin as soon as the movers leave our dispatch center, and end as soon as they return to the dispatch center. Your total bill will reflect the total duration of time from once we leave our facility to once we return. If you require our movers to assist you for any amount of time over your initial booking, we will require a payment via credit card or check and you agree to pay for all services rendered. We have a two-hour minimum purchase and only refund hours unused over the 2-hour minimum. Keep in mind the services rendered will be added to the hours used for drive time. Your appointment form & Bill of lading is the document you will fill out on our website to determine what items will be transferred during your relocation. Any item that you wish to be moved, must be on your appointment form & Bill of lading. Any items or boxes not mentioned on the Appointment form & Bill of lading will not be allowed on the truck. Make sure your appointment form & Bill of lading is 100% accurate before purchasing any service through Boulder All Star Movers, LLC.
When we arrive on the day of your move, we will begin by doing a walkthrough of your location and getting an idea on the current location and status of each of your items that will be moved that day. During this time, we will fill out an “Inventory Damaged Goods Report”. This report simply acknowledges the current state of your goods, furniture, residents & property and allows us to determine if we think it is safe to move, or if the item has been compromised prior to our arrival, which in returns mean we cannot guarantee the item is transported safely, securely, or in a way that prevents any further damage to the item. When we mark an item down on this sheet, this is acknowledging the current state of the item, and we will have you sign off on the current damages, or the item as a whole, to waive from insurance coverage and liability. By signing this document, you agree and commit to waiving these specific items from insurance and liability coverage. At no time, will Boulder All Star Movers, LLC be held liable for any damages or lost articles that were written and signed by our customers on the Inventory Damaged Goods Report.
Our other onsite form is what we call a full protection waiver. This is meant for customers who would like the process to be expedited as much as possible, without using Boulder All Star Movers, LLC's proven protection methods to ensure the safety of your goods during transit. This is for customers who do not want any blanket wrap protection, door frame protection, or any type of precautionary methods to ensure the safety and security of your goods during transport. This document will be signed prior to the beginning of the move and will eliminate all liability for your goods during transit. This method is not recommended since we cannot guarantee your items make it safely to your next location, without any of our precautionary methods and procedures.
You must make payment directly to Boulder All Star Movers for all services, and any monies that you give to our movers will not satisfy any payment requirements. You agree to pay for all hours of service rendered unless disputed within 48 hours of your scheduled appointment. We require payment for all services within 72 hours of the services being rendered. Any payments that remain outstanding more than 72 hours after your appointment will result in a referral to a collection agency to recover outstanding due balances.
In general, our services are fully refundable, minus our 4% transaction fee, but only up to 48 hours in advance of your scheduled appointment. We will do our best to accommodate changing customer needs, but any changes within 48 hours of your scheduled appointment are not guaranteed nor refundable. Similarly, any move that is scheduled within 48 hours of the scheduled job time will be nonrefundable. If you need to reschedule your move date or time, you will have a limit of two reschedules, cementing your final reschedule as our final reservation. If your final reservation still does not work after rescheduling twice, your order will be non-refundable and final.
In the event of inclement weather, Boulder All Star Movers, LLC retains the right to cancel or reschedule any moving services when weather or other conditions would endanger the health and safety of our movers, as determined in the sole discretion of Boulder All Star Movers, LLC. In the event of a cancellation, all funds paid to Boulder All Star Movers for the cancelled services will be refunded.
Any time there is adverse weather, especially snow or ice, the areas to be used in the relocation MUST BE PREPARED by the customer to allow us to safely execute the relocation. Any driveway that is covered in snow or ice or anything that prevents our trucks from safely accessing the loading/unloading area will delay the process, and will result in increased hourly charges. You must plow, shovel or clear your loading areas, especially driveways, so our trucks can safely access the area. If the area is not prepped or safely accessible as dictated in the sole discretion of Boulder All Star Movers, we will spend time, on the clock to shovel, apply ice melt, or may have to wait until the driveway or loading areas are clear. Also, Boulder All Star Movers, LLC will retain no liability or responsibility to any damage caused to driveways or loading areas while cleaning or removing any debris or snow. You will be billed for all time our movers spend prepping the area to make it safe to conduct the relocation. If you do not wish to pay us to make the area safe, you will have the option of cancelling the job, in which case you will be refunded half of your quoted relocation fees. If extra material is needed to complete or safely secure the loading or unloading areas, you will be charged an additional hour for prep time.
When Boulder All Star Movers, LLC provides services to your house, home, apartment, office, storage unit, or any other circumstance where Boulder All Star Movers, LLC is involved in a trade or service, the company and any of its affiliated members, contractors, third party contractors, partners, advisors, management, or any connection or relevant relationship to Boulder All Star Movers, LLC will retain no responsibility for any injury, damaged goods, or any misplaced, miss crated or undocumented items. Boulder All Star Movers, LLC will take extended precaution to ensure the safety of your possessions but is not responsible for damage, loss, or theft of any kind. Boulder All Star Movers, LLC is not responsible for any item or structure that is assembled or disassembled by Boulder All Star Movers, LLC. If any structure or furniture item is assembled incorrectly, you agree to hold Boulder All Star Movers, LLC harmless from any and all liability arising from faulty furniture or structural integrity. Make sure to check any bed, frame, bunk bed, or any structure assembled or disassembled by Boulder All Star Movers, LLC before using.
Boulder All Star Movers, LLC has an insurance policy as well as auto and personal cargo coverage to protect your goods against anything that might happen along the way, but we are not responsible outside of this coverage for anything that is scratched, chipped, damaged, lost, or misplaced along the way. If you purchase Moving Help services that require Boulder All Star Movers, LLC to pick up, drive, or drop off a rental truck, you must obtain extra insurance and list our driver as additionally insured onto the policy. Under no circumstance will Boulder All Star Movers, LLC be responsible for any damage, scratches, gas, cleaning, or any other related incident to a rental truck, or any vehicle not owned and registered by Boulder All Star Movers, LLC. When Purchasing Boulder All Star Movers, LLC's Moving Help Teams, Damage insurance is not covered and Boulder All Star Movers, LLC will in no way be responsible for any damage, scratches, misplaced or miss crated items, or any damage what so ever to any personal items, rental equipment, or any items damaged throughout the Moving Help period.
Nobody other than Boulder All Star Movers employees, is allowed in or around the moving vehicles or permitted to use any Boulder All Star Movers equipment at any time without written permission from Boulder All Star Movers. Our insurance only covers our Employees and not anyone else who voluntarily uses our equipment or trucks. You agree to release and hold Boulder All Stars harmless from any and all damages and injuries that may occur as a result of a violation of this provision.
Intrastate movers in Colorado are regulated by the Colorado Public Utilities Commission (PUC). Each mover should have a PUC permit number. You are encouraged to contact the PUC to confirm that the mover you are using is indeed permitted in Colorado.
A mover that is not permitted may not withhold any of your property to enforce payment of money due under the contract ('carrier's lien').
A mover must include its PUC permit number, true name, and physical (street) address in all advertisements.
You should be aware that the total price of any household move can change, based on a number of factors that may include at least the following:
Additional services you request at the time of the move;Additional items to be moved that were not included in the mover's original estimate;
Changes to the location or accessibility of building entrances, at either end of the move, that were not included in the mover's original estimate; and
Changes to the previously agreed date of pickup or delivery.
You should also be aware that, in case of a dispute between you and the mover, Colorado has an arbitration process available to resolve the dispute without going to court.

4 CCR 723-6 CODE OF COLORADO REGULATIONS

(b) In the event of a dispute between the shipper and the mover regarding the amount charged for services or concerning lost or damaged goods, the mover shall offer the shipper the opportunity to participate in binding arbitration per the requirements of § 40-10.1-507, C.R.S.
INSURANCE & LIABILITY
Standard transportation law in Colorado requires that transportation companies give you two options when transporting your goods. First, is the no cost .60/lbs. option which will cover .60 cents for every pound of the specific item that was damaged.
The next option is to offer full value coverage or repair. This is where our insurance packages are offered and serve as a great way to ensure a specific amount of coverage is placed on your goods during transit. This way, if anything does get damaged during transit, you are covered up to the amount of the Insurance you have purchased. When purchasing our Insurance options, make sure to be very specific as to the total value you would like to have. You will be fully covered up to the maximum amount under the insurance package you have purchased.
$50 for up to $500 worth of full value coverage.
$100 for up $1,000 worth of full value coverage.
$250 for up to $2,500.00 worth of full value coverage.
$500 for up to $5,000.00 worth of full value coverage.
$1,000 for up to $10,000.00 worth of full value coverage.
By deciding to purchase no insurance coverage on your move, you are electing to choose the .60 cents per pound per piece of damaged goods coverage. This is the default insurance coverage mandated by Colorado Law.
This insurance is only for the house hold goods or items that are being transported by Boulder All Star Movers, LLC. To file an insurance claim on a specific item, you will need to have either the receipt of purchase, or proof of ownership and the value of the item when it was purchased. Make sure that any item you plan to have insured under these packages has proof of purchase before purchasing our insurance. In no way, will this insurance cover anything that does not have a receipt, proof of purchase or a monetary value provided by the company who sold you the product with proof of purchase by you. In no way, will this insurance cover anything that is not listed on your appointment form [Bill of Laden] or has been approved by Boulder All Star Movers, LLC in writing for transit in our company vehicles. This insurance does not cover any claim arising from General Liability or Homeowners insurance. This insurance will also not cover any damage to your home, apartment, or storage unit. Under no circumstance will Boulder All Star Movers, LLC or any of its associates be held liable for any Damage, misplaced, or mishandled goods during the operation of relocation. Once you have signed our Service contract completion form, no insurance claims will be accepted. If you have any insurance claims that need to be addressed, you must make Boulder All Star Movers, LLC aware of the situation before you sign the completion contract.
